BrinkÃ¢â‚¬â„¢s vs. Apx to go to trial in Feb.
HOUSTONÃ¢â‚¬â€Barring any settlement in the meantime, BrinkÃ¢â‚¬â„¢s Home Security, based in Irving, Texas and ApxAlarm of Provo, Utah are set to go to court in February, according to BrinkÃ¢â‚¬â„¢s, to settle a lawsuit originally filed by BrinkÃ¢â‚¬â„¢s in August 2006. The original lawsuit alleges that Apx used improper and unlawful sales practices to steal 47 accounts from BrinkÃ¢â‚¬â„¢s and sought $900,000 in damages.
Apx in September 2007 filed a countersuit alleging that BrinkÃ¢â‚¬â„¢s engaged in improper sales practices/tactics and unfair competition. The suit seeks a court order to stop BrinkÃ¢â‚¬â„¢s from engaging in these practices.
The case will be tried in the U.S. District Court for the Southern District of Texas, Houston Division.
