HOUSTON--Barring any settlement in the meantime, Brink's Home Security, based in Irving, Texas and ApxAlarm of Provo, Utah are set to go to court in February, according to Brink's, to settle a lawsuit originally filed by Brink's in August 2006. The original lawsuit alleges that Apx used improper and unlawful sales practices to steal 47 accounts from Brink's and seeks $900,000 in damages. Apx in Sept. 2007 filed a countersuit alleging that Brink's engaged in improper sales practices/tactics and unfair competition. The suit seeks a court order to stop Brink's from engaging in these practices. The case will be tried in the U.S. District Court for the Southern District of Texas, Houston Division.
