ADT and Ring settle trademark dispute

BOCA RATON, Fla.—ADT has settled a lawsuit against Ring LLC, an Amazon company and provider of smart home security devices. As per the settlement, Ring will release a new version of its Outdoor Siren product and will discontinue the marketing and sale of the current design.

“ADT and Ring are pleased to have reached a mutually agreeable resolution,” said David Smail, Executive Vice President and Chief Legal Officer at ADT. “Ring will release a new version of the Outdoor Siren product and will discontinue the marketing and sale of the current design.”

The suit, filed in April 2021, alleged trademark infringement involving ADT’s blue octagon mark and Ring’s products. In March 2021, the complaint asserted that Ring adopted a blue octagon mark that is virtually indistinguishable from ADT’s iconic blue octagon mark, which is protected under numerous federal trademark registrations.

 ADT’s suit alleged willful trademark infringement, unfair competition, and false designation of origin under the Lanham Act, 15 U.S.C. §§ 1114 and 1125(a); common law trademark infringement; violation of Florida Unfair Competition Law; and Trademark Dilution under the Lanham Act, 15 U.S.C. § 1125(c) and under Fla. Stat. § 495.151. 

Smail added, “As we continue to innovate in the smart home technology space through new products and partnerships—including partnerships with Google and other peers in the marketplace—it’s important that we protect our customers, our IP, and our reputation.”
