Judge dismisses patent infringement lawsuit against Mobotix

NEW YORK—A patent infringement lawsuit against Mobotix Corp. has been dismissed.
Chief U.S. District Judge Fred Biery dismissed the suit, filed by San Antonio, Texas-based e-Watch Inc., according to Mobotix, a provider of network-based surveillance systems.
The judgment was entered after the U.S. Patent and Trademark Office had determined, upon the request of Mobotix, that one of four patents in the patent infringement lawsuit is not patentable, according to a prepared statement from Mobotix.
More review proceedings requested by Mobotix challenging e-Watch Inc.'s patents are pending. Decisions from those reviews are expected in the coming months, Mobotix said.
“We'll continue to take all available legal actions to defend our company against patent lawsuits,” Heidi Barnum, head of internal operations at Mobotix, said in a prepared statement.
“We are looking forward to the Patent Office's decisions in the remaining review proceedings. Although the decisions will have no relevance to this lawsuit any more, pursuing these inter partes reviews until a final decision has been reached reflects our commitment in the legal dispute with e-Watch Inc.,” Barum said in the statement.
